Service Provider Agreement

This agreement applies to every business and person who offers services on Jobbie. It sits alongside the Terms of Service. Please read it carefully — especially sections 2, 5, 7, 8, 10 and 15, which explain that you alone are responsible for your work, how Jobbie's fees work, the rules on additional costs and staying on Jobbie, and the limits on Jobbie's liability.
The key points
- You're an independent business. You set your own prices and methods, and you alone are responsible for your work, your workers, site safety, permits, licences, insurance and taxes.
- AI estimates and drafts are tools only and may be wrong. Check every line — the quote you send is yours, and sending it is your electronic signature.
- Additional costs must be approved by the customer in Jobbie before you carry out the extra work or charge for it.
- Jobbie's fees are your subscription plus a commission of 1–6% of the final job price (including approved additional costs), collected through the customer's booking deposit.
- Keep work you find on Jobbie on Jobbie. Taking a customer introduced through Jobbie off-platform within 12 months makes an introduction fee payable.
- You protect customers' personal information and use it only for their job.

1. About this Agreement
This Service Provider Agreement (the Agreement) is between Jobbie (Jobbie) and the business or person offering services on the Jobbie platform (you, a Provider). It applies together with the Jobbie Terms of Service (the Terms), which also bind you; words defined in the Terms have the same meaning here. If this Agreement and the Terms conflict, this Agreement takes priority.
You accept this Agreement electronically — on your application, when you subscribe, and when you're asked to accept a new version — and your acceptance has the same effect as a signature under the Electronic Transactions Act 1999. If you accept for a company or other business, you confirm you're authorised to bind it, and “you” includes that business and everyone who uses its Jobbie account.
2. You're an independent business
- You provide services to Customers as an independent business, on your own account. Nothing in this Agreement makes you Jobbie's employee, worker, agent, partner or joint venturer.
- You decide whether to quote on any Job, what to charge, how, when and by whom the work is done, and what tools and materials to use. You're free to work for others, on or off the Platform (subject to section 10).
- Jobbie does not undertake, perform, supervise or control any Job. Every Service Contract is between you and the Customer, and you alone are responsible for performing it.
- You're responsible for your employees, subcontractors and anyone else you bring to a Job — including their pay, conduct, safety and legal status — and for complying with the Employment Act 2000, the Workers' Compensation Act 1965 and the Occupational Safety and Health Act 1982 where they apply to you.
- You're responsible for your own taxes and contributions, including payroll tax, social insurance, health insurance and pension contributions under the Payroll Tax Act 1995, the Contributory Pensions Act 1970, the Health Insurance Act 1970 and the National Pension Scheme (Occupational Pensions) Act 1998, as they apply to you.
3. Your promises to Jobbie
You promise, now and for as long as you use the Platform, that:
- you, and anyone who works for you, are legally entitled to carry on your business and do the work in Bermuda — for example as a Bermudian, the spouse of a Bermudian, a permanent resident's certificate holder, or under a work permit that covers this work under the Bermuda Immigration and Protection Act 1956;
- you and your workers hold every licence, registration and trade certificate the law requires for the work you offer — including a National Occupational Certificate where the National Occupational Certification Act 2004 requires one (for example, for electricians and landscape gardeners);
- you'll obtain, or make sure the Customer has obtained, any building permit, planning permission or other approval a Job needs, including under the Building Act 1988 and the Development and Planning Act 1974;
- you hold public liability insurance appropriate to the work you do and, if you employ anyone, any insurance the law requires for them, and you'll show Jobbie evidence on request;
- all information you give Jobbie and Customers — including your profile, trades, specialties, portfolio, licence and insurance details, availability and standard rates — is true, accurate and not misleading, and you'll update it within 7 days of any change (including if a licence, certificate or insurance policy lapses, is suspended or is cancelled); and
- you'll comply with all laws that apply to your business and your work, including the Consumer Protection Act 1999, the Human Rights Act 1981 and the Personal Information Protection Act 2016.
4. Verification
You authorise Jobbie to check the information you give us, including with the issuing body, registry or insurer. If your licence, registration or certificate details check out, Jobbie may show a “Verified by Jobbie” badge with your quotes. The badge means only what section 4 of the Terms says — it is not a certification of your competence. It's removed automatically if the licence expiry date you gave us passes, and changing your verification details removes it until Jobbie checks them again. Jobbie may remove the badge, or refuse or remove trades from your profile, at any time.
5. Quotes and pricing
- Your price is yours. Jobbie's Estimates and AI-drafted quotes are tools only. They may be wrong or incomplete, and Jobbie makes no promise that they're accurate or reflect fair value. You must check every line against the Job — asking questions or visiting the site where needed — and set your own price independently. You're solely responsible for the scope, quantities, materials, price, compliance and safety of every Quote you send, and for not quoting for work you can't lawfully and competently do.
- Quotes are binding offers. When you send a Quote through Jobbie you confirm it and sign it electronically. It's an offer to the Customer that stays open for 30 days, unless you withdraw it before it's accepted. On acceptance it forms a Service Contract between you and the Customer on the Standard Job Terms in the Schedule to the Terms.
- Availability you state (such as an earliest start date) must be genuine.
- Standard rates you give (for example, when offering a maintenance plan at a discount) must be rates you genuinely charge.
- No price coordination. Set your prices independently. Don't use the Platform, its messages or its data to agree prices, share out Jobs or Customers, or rig bids with other providers. Market and pricing information Jobbie shows you is anonymised, aggregated and historical; use it only for your own independent decisions and don't share it.
6. Doing the work
For every Job you take on through Jobbie, you'll comply with the Service Contract and the Standard Job Terms. In particular, you'll carry out the work with reasonable care and skill and to a professional standard; comply with all laws, codes and permit conditions; take responsibility for the health and safety of everyone affected by the work (including the Customer's household and the public) and for protecting the Customer's property; communicate with the Customer through Jobbie; keep appointments or give reasonable notice if you can't; and treat Customers and their property with respect.
You alone are responsible for your work, materials and advice, and for any defect, delay, damage to property, injury, loss or claim arising from them. Any guarantee or warranty on your work is given by you, not by Jobbie.
The issue log. Every Job has a shared issue log, which forms part of the Job's record. The Customer — or you — can log a problem there; you'll be notified and can reply. Reply promptly, stick to the facts, and don't use the log to share contact details or ask to deal outside Jobbie. Entries can't be edited or deleted, and only the side that logged an issue can mark it resolved. Either party can download the Job's record, including the log. Jobbie doesn't decide disputes: it doesn't investigate, mediate or rule on issues, doesn't hold money for you or the Customer, and never pays you or the Customer on the other's behalf — the only money Jobbie acts on is refunding its own fees to the Customer under section 9 of the Terms. Any disagreement about a Job is between you and the Customer. Jobbie may take into account a pattern of issues on your Jobs when deciding whether to warn, suspend or remove you (section 16).
7. Additional costs
- If extra work or materials are needed beyond the accepted Quote, propose an Additional Cost through Jobbie, describing honestly what is needed, why, and the price.
- Don't carry out the extra work, or charge for it, until the Customer approves it in Jobbie. Bermuda law prohibits charging a consumer for goods or services outside the agreed transaction without first getting their agreement (Consumer Protection Act 1999, section 11(1)(c)(iii)). The only exception is urgent work needed to prevent immediate danger or damage: flag it as such, explain it straight away and ask for approval.
- Don't hold back costs you already know about in order to add them later, split a Job to get around these rules, or pressure a Customer to approve. A Customer can decline any Additional Cost.
- Jobbie records every Additional Cost and monitors patterns — for example, how often, and by how much, a provider's final prices exceed their Quotes — and may ask you to explain them. Repeated or unexplained additions may lead to a warning, removal of badges or trades, or suspension.
- Jobbie's commission applies to the final price of the Job, including approved Additional Costs (see section 8).
8. Fees and payment
Subscription. Access to the job pool requires an active subscription. Current plans are Basic $150, Pro $250 and Premium $350 per month, each including one listed trade, plus $100 per month for each additional trade listed on your company. Annual prepayment is discounted 10% on the full amount. Plan features (including earlier access to new Jobs, top placement of quotes for Premium, and access to the Jobbie job board for Pro and Premium) are described on the subscription page. Subscriptions are paid in advance by bank transfer, give access for 30 days (monthly) or 365 days (annual) from the date Jobbie confirms payment, and renew manually. Launch offers (such as a free first month) and referral discounts apply as described when they're offered. Subscription fees aren't refundable, except where the law requires. If your subscription lapses, access to the job pool and quoting is paused. Jobbie may change subscription prices or features on at least 30 days' notice, taking effect from your next renewal.
Commission. For every Job booked through Jobbie, Jobbie earns a commission on the final price (the accepted Quote plus approved Additional Costs): 1% for Jobs under $500, 2% from $500, 3% from $2,500, 4% from $5,000, 5% from $10,000 and 6% from $25,000 — the rate for the band the price falls in applies to the whole price — with a minimum of $5 and a maximum of $2,500. The rate is two-thirds of the standard rate where the Customer has hired you through Jobbie before.
How the commission is collected. The Customer pays the commission on the Quote to Jobbie as the Booking Deposit. You agree that the Booking Deposit counts in full toward the price the Customer owes you — so the Customer pays you the balance (the price minus the Booking Deposit) directly — and that Jobbie keeps the Booking Deposit, for its own account, in payment of your commission. If Jobbie gives the Customer a discount on the Booking Deposit, Jobbie bears that discount; it doesn't reduce what you receive. If approved Additional Costs increase the commission, Jobbie will invoice you for the difference when the Job closes.
Site visits. When a Customer books a site visit (or a paid first hour) with you, the Customer pays Jobbie a booking fee for Jobbie's own account (currently $30, $50 or $75 for a site visit depending on the size of the Job, and $15 or $20 for a paid first hour). Jobbie doesn't collect anything on your behalf and doesn't pay you any part of it. Your own charge for the visit is the amount you set on your company profile ($0 is allowed), which the Customer sees before booking; you collect it from the Customer directly — at the visit or by including it in your Quote — and Jobbie isn't responsible for collecting it. You must still complete each visit to Jobbie's Valid Assessment Standard — checking in at the property, completing the on-site checklist, and submitting a Quote in Jobbie (or a documented reason why you can't) within 72 hours. If the Customer accepts your Quote through Jobbie within 30 days of the visit, Jobbie credits its booking fee toward the Customer's Booking Deposit; this doesn't change your commission.
Other fees. A one-time plan formation fee (5% of the plan's total value, minimum $50, maximum $350) is payable if a Customer accepts a maintenance plan you offer through Jobbie. Change orders created before Additional Costs were introduced carry a 5% fee.
Invoices from Jobbie are payable by bank transfer within 14 days, using the reference shown. Jobbie may set off amounts you owe it against amounts it owes you, and may suspend your access while an invoice is overdue.
9. Payments from Customers
Customers pay you the final balance and any approved Additional Costs directly, by bank transfer to the payout account on your company profile. Keep your payout details accurate — Customers see them at the payment step, and every admin of your company is told when they change. When a Customer tells you they've paid, confirm receipt in Jobbie promptly and honestly once the money arrives (or tell us it hasn't). Jobbie doesn't hold money for you, isn't responsible for any Customer's failure to pay, and doesn't collect debts for you.
10. Keeping jobs on Jobbie
Jobbie invests in bringing you Customers and is paid only when Jobs are booked through the Platform. So:
- Until a Customer's Booking Deposit on your Quote is confirmed, don't share or ask for phone numbers, email addresses or other contact details, or suggest dealing outside Jobbie — keep messages on Jobbie. For a confirmed site visit you'll be given the Customer's address and first name only, to attend the visit; use them for that purpose alone.
- Don't ask or encourage a Customer to pay you outside the payment arrangements shown in Jobbie, or to book a Job off the Platform.
- Introduction fee. If, within 12 months after a Customer was introduced to you through Jobbie (the date you first viewed or quoted on their Job), you agree to do work for that Customer outside the Platform — for that Job or anything arising from the introduction, including after a site visit booked through Jobbie — you must pay Jobbie an introduction fee equal to the commission that would have applied under section 8 to the value of that work (or, if you don't tell us the value, to the higher of your Quote and the Estimate). This fee reflects Jobbie's legitimate interest in being paid for the introductions it makes, and is in addition to Jobbie's other rights.
- If you don't submit a Quote in Jobbie within 72 hours of a site visit, or no Quote of yours is accepted within 14 days of it, Jobbie may ask you and the Customer what happened. You agree to answer honestly and promptly, and to tell us if you've agreed to do any work for that Customer outside Jobbie.
- Jobbie may suspend or remove providers who take Jobs off the Platform.
11. Personal information you receive through Jobbie
When you receive a Customer's name, contact details, address or other personal information through Jobbie, you're responsible for it as an organisation under the Personal Information Protection Act 2016. You'll use it only to quote for and carry out that Customer's Job (and any follow-up the Customer asks for); keep it secure and confidential; not use it for marketing unless the Customer agrees; share it only with people working on the Job who need it; delete it when you no longer need it for the Job or for legal, tax or warranty records; and tell Jobbie promptly if it's lost, stolen or misused. Don't discriminate against anyone on grounds protected by the Human Rights Act 1981.
The job board. On the Pro and Premium plans you can see profiles and CVs that people looking for trade work have posted on the Jobbie job board. You may use a candidate's details only to consider them for work with your own business in Bermuda. You must keep them confidential and secure; not copy them into other lists, share, sell or publish them, or use them for marketing; contact a candidate only about genuine work; never ask a candidate for money or to pay for anything to be considered; delete their details (including any CV you downloaded) once you no longer need them for that purpose; and comply with the Personal Information Protection Act 2016, the Employment Act 2000, the Human Rights Act 1981 and Bermuda's immigration law — including checking a candidate's right to work yourself rather than relying on their answer. Jobbie records when you open a candidate's contact details or CV, limits how many you can open each day, and may suspend your job board access or your account under section 16 if you misuse it. Each listing shows a short summary Jobbie makes from the candidate's CV with the help of an AI service, and how many days the listing has been up; the summary can be incomplete or wrong, so read the CV and check the facts yourself before relying on it. Candidates are not your customers under this Agreement, and no introduction fee applies to hiring one.
12. Your content
You give Jobbie a non-exclusive, royalty-free, worldwide licence to host, copy, adapt (for example, to remove location data or contact details), display and share your profile, portfolio, photos, videos and other content on and in connection with the Platform — including to Customers comparing quotes — while you're on the Platform and for a reasonable time afterwards for records and disputes. You confirm you own the content or have permission to use it, and have the consent of anyone identifiable in it. Because quotes are anonymous until a Customer books, don't include your name, logo, vehicle markings, signage, contact details or people's faces in portfolio content.
13. Reviews
Customers may review your work, and you may rate Customers you've worked with. Reviews must be honest and based on the Job. Don't offer anything in exchange for a review, review yourself or a competitor, or retaliate against a Customer for an honest review. Jobbie may moderate or remove reviews that break these rules.
14. Personal and care services
If Jobbie opens categories for personal and care services (such as babysitting, caregiving or pet care) and you provide them, you also promise that: your name isn't on the Child Abuse Register kept under the Children Act 1998 or the Senior Abuse Register kept under the Senior Abuse Register Act 2008, and you consent to Customers or Jobbie making lawful enquiries of those registers; you'll provide a Bermuda Police Service records check on request; you hold any registration or licence required (for example, as a day care provider under the Children Act 1998); you won't describe yourself as a day care centre or care home unless you're licensed as one; and you'll comply with any duty to report abuse. Jobbie may ask for further declarations or documents before approving you in these categories, and doesn't background-check, certify or supervise care providers.
15. Responsibility and limits on liability
Your responsibility. You'll compensate Jobbie and its directors, officers, employees and agents for all losses, damages, costs, fines, penalties and reasonable legal fees arising from any claim, complaint or proceedings connected with: your services, workers, materials or advice; your breach of this Agreement, the Terms or any Service Contract; your breach of any law (including employment, immigration, tax, safety, consumer and privacy law); or your content — except to the extent caused by Jobbie's own breach or negligence.
Jobbie's liability to you. Section 17 of the Terms applies to you, with these changes because you use the Platform in the course of business: Jobbie's total liability to you in any 12-month period is limited to the subscription fees you paid Jobbie in the 12 months before the event giving rise to the claim; and you must notify Jobbie of any claim within 12 months of becoming aware of it. Jobbie doesn't promise you any number of Jobs or Customers, or any level of income. Nothing in this section limits the liabilities listed in section 17(3) of the Terms.
16. Suspension and ending this Agreement
You can end this Agreement at any time by letting your subscription lapse (there's no refund for the current period) and closing your account; Jobs you've already agreed must still be completed or properly cancelled. Jobbie may suspend or restrict your account, hide your quotes, remove badges or trades, or end this Agreement if Jobbie reasonably believes you've breached it or the Terms, given false information, received serious or repeated complaints (including a pattern of issues logged on your Jobs), taken Jobs off the Platform, let a licence, certificate or insurance policy lapse, or pose a risk to Customers or Jobbie. Where it's reasonable to do so, Jobbie will tell you why and give you a chance to respond. Sections 2, 6, 8 (for amounts already owed), 9, 10, 11, 12, 15 and 18 continue after this Agreement ends.
17. Changes
Jobbie may change this Agreement. For material changes, Jobbie will give you notice by email or in the app and ask you to accept the new version before you continue; if you don't accept it, you can end this Agreement under section 16. Fee changes need at least 30 days' notice.
18. General
Sections 22 to 25 of the Terms (notices, complaints, governing law and courts, and general terms) apply to this Agreement. This Agreement, and any dispute arising out of or in connection with it, is governed by the laws of Bermuda, and the courts of Bermuda have exclusive jurisdiction.
